For the first nine months only 41.9% of the LS`10 was implemented, another 79 draft laws remain to be implemented by the end of the year.
In the 146th meeting of the Kosovo Government, held on September 29th 2010, the Legislative Strategy 2010 was modified once again with the addition of 7 other draft laws. The added Draft laws to the Legislative Strategy 2010 were proposed by MTI (2), MEF (4) and MTPT (1):
Including these added draft laws, the number of draft laws in the Legislative Strategy 2010 goes to 136. During the first 11 months (January-November 2010) a total of 57 draft laws or 41.9% of the Legislative Strategy was approved. Another 79 draft laws remain to be approved by the end of the year, including the additional draft laws which were added on the 146th government meeting.
Out of the three above-mentioned ministries which have requested to add laws from their field to the Legislative Strategy, only MTI has succeeded to process the draft laws foreseen with the Legislative Strategy in the Government. Based on the Legislative Strategy 2010, the MTPT is obliged to process three draft laws for approved in the Government; however, none of these draft laws were approved by the Government until September (two of the three draft laws of MTPT were supposed to be approved before July 31st). The MEF also stagnated in fulfilling its obligations towards the Legislative Strategy. Out of the 23 draft laws that MEF needs to process in the Government for approval, only 9 of them have been approved. MEF has approved two draft laws: the one on Accounting, Financial Reporting and Auditing and the Draft law on Mandatory Insurance from Auto-responsibility towards Third Parties, both of which were not part of the list of the Legislative Strategy! Accounting for the additional draft laws which were added by the last decision, MEF is obliged to process an additional 18 draft laws to the Government, within the next 3 months!
If we look at the experiences from past years, usually the Legislative Strategy was never fulfilled completely. The most part of the remaining draft laws will be carried on to the Legislative Strategy 2011.
The problems with the non-implementation of the Governments' Legislative Strategy, the large number of draft laws contained by the strategy, the inability of the Assembly to approve on time the draft laws which are under processing in the Assembly, etc., have been addressed in the analysis paper of GAP Institute entitled 'Facts about the Legislative Strategy – implementation and influence in the work of the Assembly and the Government”, published on February 2010.
