The Supervisory Council of the Agency for Protection of Personal Data is appointed

The law was approved by the Kosovo Assembly on April 28th 2010. The main goal of this Law is the determination of rights, responsibilities, principles and measures related to the protection of personal data, and to establish the responsible institution for the supervision of the legitimacy of data processing. In its 146th meeting, the Kosovo Government appointed the Supervisor Council of the Agency for Protection of Personal Data.

 

In the Law for Protection of Personal Data, Article 29th, explains the agency status, where it is stated that the Agency for Protection of Personal Data is an independent agency, charged with the duty of supervising the implementation of rules for protection of data where its member work independently in compliance with the law and they must not accept any directive from other parties. The main objective of the Agency is to offer advice to public and private bodies for cases related to protection of data; to decide upon requests of the data subject; to inform the public for issues and developments in the field of data protection and to promote the fundamental rights for protection of personal data.

This Agency is led by the Supervisory Council which is consisted of the Head State Supervisor and other state supervisors. Based on Article 31 of the Law on Protection of Personal Data, the appointment of the Head State Supervisor and other state supervisors is done by the Kosovo Assembly based on the proposal of the Kosovo Government for a five year period with the possibility of appointment for a second mandate.

The Agency has its own budget, whereas the funds for the work of the Agency are ensured through the Kosovo Budget, which is determined by the Kosovo Assembly based on the proposal of the Head State Supervisor. The proposals for the Head State Supervisor and other State Supervisors will be submitted to the Assembly for approval, in full accordance with the Law on Protection of Personal Data.
